These Terms & Conditions (“Terms”) govern the use of our pledge management services for any projects created by Urbantek Games (“we,” “us,” or “our”). Urbantek Games operates in Australia (South Australia).

By accessing or using any pledge manager (“Pledge Manager”) that we employ—including platforms hosted by Hive Interactive—or by submitting information to us in connection with our crowdfunding campaigns and post-campaign pledge management, you (“backer,” “user,” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please refrain from using the Pledge Manager.

3. Description of Products & Rewards
Our Offerings

Urbantek Games produces various tabletop games, card games, role-playing game accessories, and related merchandise (“Products”).
Specific details regarding each Product, such as descriptions and images, are provided within the Kickstarter campaign page, our website, or the Pledge Manager.
Age Restrictions

Unless otherwise specified for a particular Product, our games are suitable for general audiences.
4. Fulfillment & Shipping
Production & Shipping Timeline

Estimated production and shipping timelines for each project will be communicated via Kickstarter updates, our website, or directly in the Pledge Manager.
These timelines are estimates and may be subject to change due to events outside our control (e.g., holiday closures, supplier delays, logistics issues, etc.).
Shipping Regions

We generally ship worldwide where feasible. However, some regions may be excluded if shipping logistics or legal restrictions apply. Any exclusions or special restrictions will be detailed in the relevant campaign materials.
Shipping Costs

Shipping costs are typically calculated during the checkout process in the Pledge Manager, unless stated otherwise.
In some cases, local pickup or special pledge tiers (e.g., “Sponsor” pledges) may include free or reduced shipping. Details will be specified in the relevant campaign.
Delivery Delays

Delivery times are estimates and can be affected by factors such as manufacturing delays, holidays (e.g., Chinese New Year), or unforeseen events. We will do our best to keep backers informed of any changes in the schedule.
5. Pledge Cancellations & Refunds
Cancellations After Campaign Ends

Once a Kickstarter (or other crowdfunding) campaign is completed, cancellations are not generally permitted. If you have concerns (e.g., shipping costs), please reach out to us at curtis@urbantek.online to discuss options.
Refund Policy

We do not offer refunds except in cases where the product arrives damaged during shipping. In such cases, you must provide proof of transit-related damage (e.g., photos of the damaged packaging and product).
Returns

If a return is authorized (e.g., due to damage or other exceptional circumstances), the backer is responsible for any return shipping costs unless otherwise agreed.
6. Payment & Fees
Payment Methods

The Pledge Manager will generally accept credit card payments. Additional payment methods may be offered depending on the platform or country.
Additional Fees

Unless stated otherwise, any fees associated with pledge management (e.g., platform fees, Hive Interactive fees) are absorbed by Urbantek Games and are not passed on to backers.
Taxes, duties, or customs fees may apply depending on your region’s import laws. These are the responsibility of the backer unless specified otherwise in the campaign details.
7. Backer Responsibilities
Accurate Information

You agree to provide accurate, up-to-date, and complete shipping information. The address you provide during the survey or checkout is where your pledge will be sent. Please verify you have access to receive shipments at that location.
Use of Pledge Manager

You agree not to engage in any fraudulent or unauthorized use of the Pledge Manager.
You agree to comply with all applicable laws and regulations when using this service.
8. Intellectual Property
Ownership

All content, designs, images, and trademarks related to Urbantek Games products are the exclusive property of Urbantek Games unless otherwise noted.
No rights or licenses are granted to backers except for the limited right to receive and use the physical or digital products per these Terms.
Third-Party Materials

If any third-party materials are used or referenced, we will provide notice in the relevant product descriptions or campaign materials.
9. Privacy & Data Handling
Data Collection

We collect personal data (e.g., name, address, payment information, and possibly phone numbers) only as needed to fulfill pledges, provide customer support, and communicate with backers.
Data Usage

Your data is used solely for shipping, handling, or contacting you regarding your pledge(s).
Third-Party Sharing

We may share your data with the pledge manager platform (e.g., Hive Interactive) and our manufacturing or fulfillment partners as necessary to process and ship rewards.
We do not sell or distribute your data to unrelated third parties.
Security Measures

We use secure methods to handle personal data, but no method of transmission or storage is 100% secure. By using the Pledge Manager, you acknowledge and accept this inherent risk.
10. Disclaimers
Production & Delivery

While we strive to meet our projected timelines and provide high-quality products, delays or issues may arise due to factors outside our control. We will inform backers promptly of any significant changes.
No Liability for Indirect Damages

To the fullest extent permitted by law, Urbantek Games is not liable for any indirect, consequential, or incidental damages arising out of or related to the use of the Pledge Manager, delays in delivery, or any other aspect of the fulfillment process.
11. Governing Law & Dispute Resolution
Governing Law

These Terms are governed by and construed in accordance with the laws of South Australia, without regard to its conflict of law provisions.
Mediation and Arbitration

In the event of a dispute, both parties agree to first attempt mediation to reach a mutually acceptable resolution.
If mediation fails, any unresolved dispute shall proceed to arbitration under the applicable rules in South Australia. The arbitrator’s decision will be final and binding, unless otherwise required by law.
12. Modifications to These Terms
We reserve the right to update or modify these Terms at any time. Any changes will be posted on our website at games.urbantek.online or communicated through campaign or pledge manager updates. By continuing to use the Pledge Manager after such updates, you agree to the revised Terms.
13. Acceptance of Terms
By accessing or using any Urbantek Games pledge manager or submitting your pledge information, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety.
