Please read these Terms and Conditions carefully before completing your Pledge Manager. By completing and submitting your Pledge Manager, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms apply to all backers worldwide, with additional provisions for backers located in the United States, the United Kingdom, and the European Union.

1. Pledge Manager Deadline
Please complete your Pledge Manager and lock your shipping address no later than July 20, 2025, when the Pledge Manager will close.

If you do not complete your Pledge Manager by the deadline, please reach out to us at sarah@csquaredgames.com. Pledges will be considered abandoned 30 days after the close of the pledge manager. No refund will be issued for abandoned pledges. Because all products were manufactured based on commitments made by backers during the crowdfunding campaign, we are unable to refund pledges that are not completed.

Address Changes After Submission: If your shipping address changes after you have submitted your Pledge Manager, you are responsible for contacting us promptly with your updated address. We cannot guarantee address changes will be honored once fulfillment has begun. We are not responsible for shipments delivered to an address you provided that is no longer current.

2. Estimated Delivery
Iberia: Kings and Emirs is currently expected to be delivered in September or October 2026. This is an estimated delivery date only and is subject to change.

Delivery may be delayed due to factors beyond our reasonable control, including but not limited to:
• Manufacturing or production delays
• Port congestion or freight shipping delays
• Customs processing times
• Force majeure events (natural disasters, pandemics, governmental actions, labor strikes, etc.)

We will communicate updates to all backers regarding the progress of fulfillment through our official campaign update channels (Kickstarter and Hive). We appreciate your patience and understanding.

3. Shipping, Taxes, and Customs
By completing your Pledge Manager, you are paying for all applicable shipping fees, VAT (where applicable), and sales tax (where applicable) at the time of Pledge Manager completion.

We will cover all import customs duties and tariffs on your behalf. You will not be charged additional customs fees upon delivery. If a customs or duty charge is incorrectly assessed at delivery, please contact us so we can assist in resolving the issue.

Note: Shipping fees, tax rates, and VAT amounts are calculated based on your delivery location and the information provided in your Pledge Manager. Ensure your shipping information is accurate to avoid discrepancies.

4. Damage and Missing Components
We take great care in the packaging and fulfillment of Iberia: Kings and Emirs. However, if your copy arrives damaged or with missing components, please review the following:

4.1 Reporting Window
You must report any damage or missing pieces within 30 days of receiving your game. Claims submitted after this window may not be eligible for resolution. To report an issue, contact us at sarah@csquaredgames.com with your order information and photos of the damage or a description of missing components.

4.2 Assessment
All damage and replacement requests will be assessed on a case-by-case basis. Due to limited stock, we are unable to replace copies for minor cosmetic issues (referred to below as 'normal dings') that may occur during the shipping process.

4.3 Replacement Eligibility
Replacement will be considered for the following:
• Water damage (e.g., the game was soaked by rain or moisture during transit)
• Severe tears or crushing that renders components unusable
• Damage that materially impacts the play of the game

Normal minor dents, scuffs, or 'dings' to box corners or edges that occur during standard shipping will NOT be eligible for replacement due to limited stock availability.

4.4 City Wall Replacement Pieces
All copies of Iberia: Kings and Emirs include a set of replacement city wall pieces, as these are the most delicate components in the game. These replacement pieces are included proactively in every copy and do not require a separate claim.

5. Nature of Crowdfunding Pledges
Your pledge was made during a crowdfunding campaign in which the product was designed, produced, and fulfilled based on backer commitments. As such:
• Pledges are not traditional retail purchases and are subject to the inherent risks of crowdfunding, including production and delivery delays.
• By pledging, you acknowledged and accepted these risks at the time of your original pledge.
• Refunds will not be provided for change of mind once your Pledge Manager has been submitted and your order locked.

6. Additional Terms for United States Backers

6.1 Sales Tax
Sales tax will be collected where required by applicable U.S. state and local law based on your shipping address. The applicable sales tax rate will be calculated and displayed in your Pledge Manager before submission.

6.2 Dispute Resolution
For U.S. backers, any disputes arising from these Terms and Conditions or your pledge shall first be addressed through good-faith communication with our support team. We encourage resolution through direct communication before pursuing other remedies. Nothing in these Terms limits any rights you may have under applicable federal or state consumer protection laws.

6.3 Warranty Disclaimer
To the extent permitted by applicable law, Iberia: Kings and Emirs is provided 'as described' in the crowdfunding campaign. We make no additional warranties, express or implied, beyond what is stated in these Terms.

7. Additional Terms for United Kingdom Backers

7.1 VAT
Value Added Tax (VAT) will be collected on applicable orders delivered to addresses in the United Kingdom in accordance with UK VAT regulations. The VAT amount will be displayed in your Pledge Manager before submission.

7.2 Consumer Rights
Nothing in these Terms and Conditions affects your statutory rights under UK consumer protection law, including but not limited to the Consumer Rights Act 2015. If your game arrives in a condition that does not conform to the description provided in the crowdfunding campaign, you may be entitled to a repair, replacement, or refund under applicable law.

7.3 Right to Cancel
Please note that because Iberia: Kings and Emirs is a bespoke/custom-produced item manufactured in reliance on your pledge commitment, the standard 14-day cancellation right under the Consumer Contracts Regulations 2013 may not apply once production has commenced. If you have questions about your rights, we encourage you to contact us directly or seek independent legal advice.

8. Additional Terms for European Union Backers

8.1 VAT and Import
For backers in EU member states, VAT and applicable import fees will be collected at checkout in your Pledge Manager in accordance with EU VAT rules (including the Import One-Stop Shop (IOSS) regime where applicable). You will not be charged additional VAT or customs duties upon delivery.

8.2 Consumer Rights under EU Law
Nothing in these Terms and Conditions is intended to limit or exclude any rights you have as a consumer under applicable EU law, including Directive 2019/771 on the sale of goods. If your product does not conform to the contract description, you may have the right to request repair, replacement, a price reduction, or a refund as provided under applicable EU and national consumer law.

8.3 Right of Withdrawal
Under the EU Consumer Rights Directive (2011/83/EU), consumers generally have a 14-day right of withdrawal from distance contracts. However, because Iberia: Kings and Emirs is a product made to order and manufactured based on your pledge, this right of withdrawal may not apply once production has commenced, pursuant to Article 16(c) of the Directive. By completing your Pledge Manager after production has begun, you acknowledge this exception. If you have questions about your rights, please contact us or consult your national consumer authority.

8.4 Alternative Dispute Resolution
EU backers have access to the European Commission's Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr. 9. Limitation of Liability
To the fullest extent permitted by applicable law, our total liability to you in connection with your pledge shall not exceed the total amount paid by you in connection with your pledge (including shipping and taxes). We shall not be liable for any indirect, incidental, or consequential damages arising out of or related to your pledge or the fulfillment of your order.

Nothing in this section limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

10. Changes to These Terms
We reserve the right to update or modify these Terms and Conditions at any time prior to the close of the Pledge Manager. Material changes will be communicated to backers through official campaign update channels. Your continued use of the Pledge Manager after such notification constitutes acceptance of the updated terms.
