株式会社AoharuNEXT（以下「当社」といいます）は、KickstarterプラットフォームおよびHive（以下「各プラットフォーム」といいます）を通じて提供する「FocusRayシリーズ」の販売に関し、以下の通り利用規約（以下「本規約」といいます）を定めます。

1. 適用範囲
本規約は、各プラットフォームにおいてFocusRayシリーズの支援（プレッジ）を行ったすべての購入者（以下「ユーザー」といいます）に適用されます。ユーザーが支援を行った時点で、本規約に同意したものとみなします。

2. 商品の性質と免責事項
開発段階の製品：FocusRayシリーズはクラウドファンディング形式での販売であり、製品開発・生産状況により、デザイン・仕様・販売価格・納期が変更になる可能性があります。
不可抗力：自然災害、疫病、物流網の遮断、原材料の調達困難など、当社の責によらない事由による遅延・不履行について、当社は責任を負いかねます。

3. 返金および返品ポリシー
3.1 ユーザー都合による返金・返品
原則不可：クラウドファンディングおよびプレッジマネージャーを通じた販売の性質上、プロジェクト終了後のユーザー都合によるキャンセル、返品、返金には応じかねます。
住所変更：配送先住所の変更は、所定の期限内にプラットフォーム上の管理画面からユーザー自身で更新を行うものとします。期日後の変更による配送遅延や不達については、当社は責任を負いかねます。

4. 配送に関する規定
配送時期： 各プロジェクトページに記載された配送予定時期は目安であり、生産・配送状況により変動する可能性があります。
受取拒否・長期不在： 配送先不明、または長期不在により当社に製品が返送された場合、再発送にかかる費用は全額ユーザーの負担となります。また、保管期間経過後に連絡が取れない場合は、注文を破棄できるものとします。

5. 個人情報の取り扱い
当社は、ユーザーから取得した個人情報を、製品の配送、アフターサポート、および当社製品に関する案内の目的以外には使用しません。詳細は当社のプライバシーポリシーに準じます。

6. 準拠法および管轄裁判所
本規約の解釈および適用は、日本法に準拠します。
本規約に関して紛争が生じた場合は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

お支払い時期
クレジットカード決済・PayPalをご利用の場合：商品の注文が完了した時点でお支払いが確定されます。

不良品等の交換及び返品（返品ポリシー）
・地震、火災、その他やむを得ない事情により商品の生産・製造が困難となった場合には、お客様のご注文をキャンセルの上、　当社より返金処理をさせていただくことがございます。大変ご迷惑をおかけいたしますが、あらかじめご了承ください。
・ご注文確定後のお客様都合での返品は受け付けておりません。
・初期不良品等の場合、当該商品は使用せず以下の手順に沿って、期間内にお手続きをお願いいたします。
　使用済み商品の場合や、お手続きの期限を過ぎてしまった場合につきましては、返品・交換に応じられない場合がございます。

1.商品到着後7営業日以内に、customer@aoharunext.co.jpまたは当ストアお問合せフォームより、商品の状態について詳細にご連絡をお願いいたします。当社担当者より交換方法についてご案内いたします。
2.当社担当者の案内に従い、商品到着後2ヶ月以内に該当の商品を当社までご返送ください。
3.当社にて商品を確認後、良品との交換作業を行います。
※該当商品の在庫状況によっては返金での対応とさせて頂く場合がございます。あらかじめご了承ください。

受け取り拒否・長期不在・住所不備の場合の対応について
ご注文いただいた商品につきまして、受取拒否・長期不在・住所不備等のいずれかの理由によりお届けができず、当社に返送された場合、3ヶ月間は当ストアにて保管いたしますので、お手数ですがcustomer@aoharunext.co.jpまたは、当ストアお問合せフォームより、ご連絡をお願いいたします。

商品が返送された場合、再配達における送料はお客様がご負担いただくことになりますので、当ストアの案内に従って送料をお支払いください。
お客様ご都合で指示不励行・受取拒否された場合、返金対応しかねますので、あらかじめご了承ください。

保管期間である3か月間経過後は、既にご購入いただいた商品については商品受取りの意思がないものとみなし、当該商品を当ショップの判断で処分できるものといたします。この場合、キャンセル手数料として商品代金の100％、送料及び当該商品の保管に要した費用を請求できるものとします。


クーリングオフ制度について
通信販売はクーリングオフ制度（無条件解約）の対象外です。

AoharuNEXT Inc. (hereinafter referred to as "the Company") establishes the following Terms and Conditions (hereinafter referred to as "these Terms") regarding the sale of the "FocusRay Series" provided through the Kickstarter platform and Hive (hereinafter referred to as "the Platforms").

1. Scope of Application
These Terms apply to all purchasers (hereinafter referred to as "Users") who have supported (pledged for) the FocusRay Series on the Platforms. By pledging, the User is deemed to have agreed to these Terms.

2. Nature of the Product and Disclaimer
Product in Development: The FocusRay Series is sold in a crowdfunding format. Design, specifications, sales price, and delivery dates are subject to change based on product development and production status.

Force Majeure: The Company shall not be held liable for any delays or non-fulfillment caused by circumstances beyond the Company's control, including but not limited to natural disasters, epidemics, disruption of logistics networks, or difficulties in procuring raw materials.

3. Refund and Return Policy
3.1 Refunds/Returns Due to User Convenience
Generally Not Accepted: Due to the nature of sales through crowdfunding and pledge managers, the Company does not accept cancellations, returns, or refunds for User convenience after the project has ended.

Change of Address: Users must update their delivery address through their account management page on the Platforms within the specified deadline. The Company is not responsible for any delivery delays or non-delivery caused by updates made after the deadline.

4. Shipping Provisions
Delivery Timing: Delivery estimates listed on project pages are tentative and may fluctuate based on production and logistics conditions.

Refusal of Receipt/Long-term Absence: If a product is returned to the Company due to an unknown delivery address or long-term absence, the User shall bear all costs for re-shipment. Furthermore, if the Company cannot contact the User after the storage period expires, the order may be discarded.

You are also responsible for providing correct address information and ensuring this address is deliverable by normal methods. At the same time, you need to monitor the project's Kickstarter updates, and all emails concerning the delivery process. If failure to follow these procedures results to the package not being delivered, you will have to pay the shipping costs to be sent again.

You agree that our responsibility to you is to ship your rewards as entered into our pledge manager system, you are responsible for import duties or any other duties that may be payable to the relevant tax authorities (import duties may apply to all countries except US, Canada, Australia, China, UK and European Union Countries).

5. Handling of Personal Information
The Company will not use personal information acquired from Users for any purpose other than product delivery, customer support, and guidance regarding the Company's products. Details shall comply with the Company's Privacy Policy.

6. Governing Law and Jurisdiction
The interpretation and application of these Terms shall be governed by Japanese law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
