Terms & Conditions for the EVA Engine 1.5 Pledge Manager
By confirming your order, providing payment information, and submitting your pledge in this Pledge Manager (hosted by Hive Interactive), you agree to these Terms and Conditions, which form a binding agreement between you ("Backer") and the Project Creator ("Creator," "we," "us").
1. Acceptance of Terms
1.1. Agreement: Your use of this Pledge Manager is governed by these Terms and Conditions, as well as the overarching Hive Terms of Service. 1.2. The Creator is Responsible: You acknowledge that the Creator is responsible for the Project's creation, manufacturing, fulfillment, and any refunds. Hive is solely the platform provider facilitating the collection of information and funds, and is not a party to the agreement between the Creator and the Backer.
2. The Nature of Your Pledge
2.1. Not a Retail Purchase: You acknowledge that your pledge is an act of supporting a creative project, and is not a traditional retail purchase. You are funding the creation of the Project, and are pre-ordering the associated rewards. 2.2. Product Risks: The final look, materials, and content of the rewards are subject to change and may differ substantially from what was presented during the initial crowdfunding campaign. By pledging, you accept the risk that the Project may change or, in rare circumstances, face delays or cancellation.
3. Order Confirmation and Payment
3.1. Pledge Confirmation Deadline: You must confirm your pledge, provide your shipping address, and pay all outstanding balances (including shipping fees and VAT/Taxes, if applicable) before the Pledge Manager deadline: October 31, 2025. 3.2. Unconfirmed Pledges: If you fail to confirm your pledge by the deadline, your pledge may be treated as a donation to the Project, and the Creator's obligation to fulfill your rewards will be considered satisfied, although we may, at our sole discretion, offer a refund less fees (see Section 5.3). 3.3. Payment: All charges in the Pledge Manager are instant and are processed through third-party payment providers (e.g., Stripe, PayPal). We are not responsible for any issues or fees arising from these external payment processors.
4. Shipping, Customs, and Taxes
4.1. Shipping Fees: Shipping fees are calculated and charged within the Pledge Manager based on your shipping address and the contents of your order. These fees are non-negotiable once paid. 4.2. Accurate Address: You are solely responsible for providing an accurate and complete shipping address. We will not be liable for any loss or failure of delivery due to an incorrect address provided by you. If a package is returned due to an incorrect address, you will be responsible for the cost of re-shipment. 4.3. International Backers (Duties and Taxes): Customs Fees/Import Duties: you are responsible for any import duties, customs fees, VAT, GST, or other taxes applied by your local customs authority upon delivery. We cannot undervalue shipments to help you avoid these fees. 4.4. Title and Risk of Loss: Title and risk of loss for your order pass to you upon delivery of the goods to a common carrier for shipment.
5. Refund and Cancellation Policy
5.1. General Refund Policy: We offer refunds based on the following schedule, calculated from the date your payment was processed in the Pledge Manager: * Within 7 Days of Payment: Full refund, minus the non-refundable fees (see Section 5.3). * After 7 Days of Payment, and Before Production Begins: Refund of 70% of your total pledge, less all non-refundable fees (see Section 5.3). This deduction covers expenses already incurred on project development, marketing, and administration. * After Production Begins: No refunds are offered as your funds have been fully committed to manufacturing.
5.2. How to Request a Refund: All refund requests must be made by emailing antisocialgaames@gmail.com. 5.3. Non-Refundable Fees: The following amounts are non-refundable in all cases, as they are non-recoverable third-party costs: * The original crowdfunding platform fees 5% * Payment processing fees 3-5% * Hive Pledge Manager fees 3%.
5.4. Cancellation by Creator: We reserve the right to cancel your order at any time, for any or no reason. If we cancel your order, we will issue a full refund of all payments received from you, including all third-party fees.
6. Project Fulfillment and Limitation of Liability
6.1. Estimated Delivery Date: Any delivery dates provided are estimates only. Project production and logistics are subject to unforeseen changes and delays. We will communicate any significant changes to the timeline via Kickstarter updates. 6.2. Warranty: If you receive a reward with manufacturing defects, or if parts are missing, you must contact us at antisocialgaames@gmail.com within 1 month of receiving your package, and we will work to provide replacement parts. We may require photo evidence of the defect. 6.3. Limitation of Liability: Our liability to you shall be restricted, to the extent allowable by law, to the amount received directly from you by the Creator. We shall not be liable for any indirect, incidental, or consequential damages.
