Terms & Conditions — Nightmare Unleashed

These Terms & Conditions ("Terms") govern your participation as a backer in the "[Project Name]" campaign, including any pledges, add-ons, and purchases made through our Kickstarter campaign and our Hive Pledge Manager. By backing this project or completing a pledge through Hive, you agree to these Terms.
1. Who We Are
"Nightmare Unleashed" and all other related products is published by Aenarion's Coven S.r.l.s., a limited liability company incorporated under Italian law.

Throughout these Terms, "we," "us," and "our" refer to [Company Legal Name] S.r.l.s.
2. The Project
"Nightmare Unleashed" is a tabletop role-playing game product (e.g. adventure module, bestiary, supplement) for Dungeons & Dragons 5th Edition, funded through Kickstarter and fulfilled via the Hive Pledge Manager. Kickstarter pledges are not pre-orders; they are contributions to help us create and deliver the product described in our campaign.
3. Pledges, Add-Ons, and Payment
Your initial pledge amount is collected by Kickstarter at the end of a successful campaign.
After the campaign ends, you will be invited to complete your pledge through the Hive Pledge Manager, where you may select add-ons, provide your shipping address, and pay any additional costs (add-ons, shipping, applicable taxes).
Payments made through Hive are processed via Stripe, PayPal, or other supported payment methods, and are subject to Hive's own payment terms.
All prices are listed in [currency, e.g. USD/EUR] and are inclusive/exclusive of VAT as noted at checkout.
Add-ons and pledge upgrades are subject to availability and may be limited in quantity.
4. Estimated Delivery and Production
Estimated delivery dates are our best good-faith estimate based on current production plans. TTRPG and publishing projects can face delays due to factors including but not limited to manufacturing, shipping, art production, and playtesting revisions.
We will provide regular updates via Kickstarter and Hive regarding production progress and any changes to the estimated delivery timeline.
Delays do not entitle backers to a refund unless otherwise stated in these Terms or required by applicable law.
5. Custom Content Submissions (e.g. "Build Your Phobia")
Certain add-ons allow backers to submit custom concepts, ideas, or content (e.g. a custom "Phobia" monster concept) to be developed and potentially included in the final product.
By submitting content, you grant us a worldwide, royalty-free, perpetual license to use, adapt, and publish the submitted concept (or a derivative interpretation of it) as part of the final product, including in future reprints, digital versions, or related materials.
We reserve full creative and editorial control over how submitted concepts are developed, balanced, and incorporated, including the right to modify or not include a submission if it does not fit the project's design, tone, or legal requirements.
Submitting content does not transfer authorship credit obligations beyond what we explicitly offer as part of the relevant reward tier (e.g. name credit), unless otherwise agreed in writing.
You confirm that any content you submit is your own original work and does not infringe on the rights of any third party.
6. Shipping
Shipping costs are calculated separately from your pledge and are collected through Hive based on your delivery address, weight, and destination.
We are not responsible for delays, loss, or damage caused by shipping carriers once a package has left our fulfillment center, though we will make reasonable efforts to assist with claims and replacements where possible.
Customs fees, import duties, and local taxes, where applicable, are the responsibility of the backer unless explicitly stated otherwise.
7. Refunds and Cancellations
Refund requests for amounts collected through Kickstarter must be handled directly on Kickstarter, in accordance with Kickstarter's own policies.
Refund requests for amounts collected through Hive (add-ons, shipping, upgrades) can be requested via a support ticket in Hive and are handled at our discretion, subject to production status (e.g. once physical production has begun, some costs may be non-refundable).
If a backer's pledge is cancelled or refunded, any custom content submitted as part of that pledge may still be considered for inclusion at our discretion, unless the backer requests its removal.
8. Digital and Physical Rewards
Digital rewards (e.g. PDFs) will be delivered via download link through Hive or another designated platform.
Physical rewards will be shipped to the address provided by the backer in Hive. It is the backer's responsibility to ensure their shipping address is accurate and up to date before the address lock date, which will be announced in advance. We are not responsible for rewards lost due to an incorrect or outdated address provided by the backer.
9. Intellectual Property
All original content we create for this project (text, art, stat blocks, mechanics, branding) remains our intellectual property, except where explicitly licensed otherwise (e.g. Open Game License / ORC materials, where applicable).
Backers may not reproduce, redistribute, or resell the final product or its components without our written permission, beyond standard personal and at-table use.
10. Limitation of Liability
To the extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising from participation in this campaign, delays, or product defects beyond the value of the pledge paid.
Nothing in these Terms limits any statutory rights you may have as a consumer under the laws of your jurisdiction (including EU consumer protection law, where applicable).
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in the campaign, production process, or legal requirements. Material changes will be communicated via a Kickstarter or Hive update. Continued participation after such changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Italy, without prejudice to any mandatory consumer protection rights you may have under the laws of your own country of residence.
